Birža Terms of Service and Listing Rules
Version: 14 October 2026. Effective date: 14 October 2026.
Operator and service
Birža is operated by Lukas Plachtinas, an individual in Lithuania. Support and notices: info@birza.app. Correspondence address: B. K. Balučio g. 21B, LT-11305 Vilnius, Lithuania.
Birža lets people browse and publish classifieds in the categories offered in the app, including vehicles and property. Buyers and sellers arrange their own transactions. Unless expressly stated for a particular service, Birža does not own the advertised items, act as the seller, inspect them or process payment. A listing appearing in the app is not a guarantee of its accuracy or safety.
The initial beta is free to use. Download, registration and posting listings are free. Optional paid promotion, such as listing bumps, may be introduced later. Any future paid feature will disclose its price and separate conditions before use.
Eligibility and accounts
You must be at least 14 to create an account or publish a listing. If you are 14–17 and do not have full legal capacity, you need your parent’s or legal guardian’s consent and supervision. They must agree to your use of the service and the obligations you undertake. Creating an account or publishing an ad does not give you legal authority to complete a transaction. Obtain any representation, consent and notarial approval required for the particular sale or rental, especially for real estate. A professional user must be authorised to act for the business they represent and supply any legally required trader information.
Provide accurate details, protect login codes and use only accounts you are authorised to access. Do not impersonate others or evade a suspension. Accept these terms before creating/uploading content. A privacy-policy acknowledgement does not substitute for consent where a separate consent is required.
Listing rules
Only advertise items or property you own or are authorised to sell or rent. Choose the appropriate category, provide truthful descriptions, prices and contact details, disclose relevant defects and availability, and update or remove listings when circumstances change. Identify professional activity accurately. Use photos and text you have the right to publish.
The following are prohibited:
- Fraud, phishing, deceptive offers, impersonation, stolen goods, counterfeit
items, illegal transactions and attempts to collect payments dishonestly.
- Sexual exploitation or abuse, any content endangering children, pornography
or sexually explicit material unrelated to the classifieds service.
- Hate speech, discriminatory abuse, harassment, threats, encouragement of
violence, terrorist promotion and graphic violence unrelated to a lawful ad.
- Publishing another person's private data without authority, or using support
or listing content to expose, intimidate or stalk someone.
- Infringement of copyright, trademarks, privacy or other legal rights.
- Weapons, drugs, illegal services and other restricted goods outside Birža's
supported categories; any item whose sale or advertising is unlawful.
- Spam, misleading duplicate listings, malware, interference with security,
unauthorised scraping and manipulation of statistics, reports or moderation.
Do not include identity documents, payment-card details, account passwords or authentication codes in listings or support attachments.
Your content
You retain rights to your content. You grant Birža a non-exclusive licence to store, reproduce, resize, display and process it only as needed to operate, distribute and moderate the service, including through service providers. This does not grant permission for unrelated advertising use. The licence lasts while the content is needed for those purposes, subject to justified retention described in the privacy policy and applicable law. You must have authority to grant these rights, including for any third-party material you upload.
Moderation, reports and appeals
Birža uses automated content checks and human review. Submitted listing text and photos may be processed by OpenAI for moderation as described in the privacy policy. Automated checks can make mistakes. We may hold, reject or remove a listing, restrict features or suspend an account for violations, legal duties or a credible safety risk, using proportionate action.
Use “Report listing” to flag a suspicious or objectionable ad and “Block seller” to hide that seller's listings for your account. Blocking does not remove the seller from the service. You may also email info@birza.app, including without an account. Include the listing link/identifier, the issue and supporting information. We review reports and take appropriate action.
If you disagree with a decision, contact support or info@birza.app with the listing identifier and reasons. We will review the challenge and explain the outcome. Moderation appeals are reviewed by the operator, including a human review of automated decisions. We respond as soon as reasonably possible and normally within one month. We explain the decision and any correction. This process does not restrict any statutory complaint or dispute-resolution rights. A verification badge only indicates the stated check; it does not guarantee an item or transaction.
Transactions and beta availability
Check the seller, item, documents and transaction arrangements yourself. Buyers and sellers remain responsible for their contracts, taxes, legal disclosures and obligations to each other. Mandatory consumer rights continue to apply; these terms do not replace the seller's obligations.
The beta may contain faults or interruptions. We may update features, fix issues or temporarily limit access. We will not use the beta status to exclude rights or responsibilities that cannot legally be excluded. To the extent permitted by law, responsibility for user-provided offers and independent transactions rests with the relevant users. Nothing limits liability where doing so would be unlawful, including applicable liability for intentional wrongdoing.
Leaving, changes and disputes
You may stop using Birža and request deletion through profile settings or email info@birza.app. Data deletion and any justified retention are described in the privacy policy. Obligations relating to existing transactions remain.
Material changes to these terms will be communicated before they take effect where required, and renewed acceptance requested where appropriate. You can stop using the service if you do not accept the changed terms. A new version will show its effective date.
Lithuanian law applies subject to mandatory protections in your place of residence. This does not remove consumer rights to bring proceedings before the courts available under applicable law. Send complaints first to info@birza.app so we can investigate; this does not prevent use of a court, authority or available statutory dispute-resolution procedure.
